October 31, 2008 – This is a question that you have probably not asked yourself. According to the Constitution, to serve in the US Senate - which he currently does - requires US citizenship. But there is now a small but growing group of people who are actually questioning Obama’s citizenship credentials in the federal court system. To date, they have not had much success, but the courts have skirted the issue and thrown the case out on a technicality. An attorney who filed one such case is now appealing. The reason that ACCESS has decided to look at this story a little more closely is because if it gains legs, it could lead to a constitutional crisis and have serious repercussions on US financial markets. It's utter (and long discredited) disinformation, chiefly led by right-wing talkshow hosts who have no scruples about making completely unfounded assertions for ratings. (I know - I used to work with Michael Savage.)

Do you trust the non-partisan factcheck.org? http://tr.im/pq7 or PolitiFact http://tr.im/pq9 ? They debunked this b.s. back in June.

@leolaporte As the article mentions, the birth cirtificate is only one issue. It would seem that the citizenship issue also hinges on his status with Indonesia. Was he actually a citizen of Indonesia? If not, its unlikely that he could have gone to school there. If so, then when did he regain his US citizenship? The fact that the courts won't allow citizens to address these issues only adds to the controversy. It also virtually guarantees that after the election there are going to be a flurry of legal challenges. That's not good for the country regardless of who you are voting for.

Yeah, I guess no one in the ENTIRE U.S. Government thought to check to see if the guy was eligible to hold the highest office in the land. And if so, what does that say about our Government if it's so completely and utterly sloppy that it would leave it to a site called "Guard My Credit File" to discover that the U.S. electorate has gone 99.9999999% of the way towards electing its leader WITHOUT CHECKING TO SEE IF THE CANDIDATE IS ELIGIBLE TO RUN????

Is this crud really even worthy of discussion on a group such as Social Median?

@rhinnc Release what? Factcheck.org got the birth certificate and verified it with the state of Hawai'i. Courts have summarily dismissed suits in Seattle, Philadelphia, and just today in Ohio. http://tr.im/pvg These lawsuits are by crackpots who refuse to believe irrefutable evidence. There is NO question about Obama's eligibility. None. Zero. It's a bogus issue. Find something else to complain about.

From the Seattle Post Intelligencer today: "the Hawaiian health department director said Friday that she and the registrar of vital statistics have personally verified that the health department holds Obama's original birth certificate."

This is just another false side issue designed to distract people away from focusing on what really matters. Which candidate is better able to lift us out of the mess that George Bush got us into? My vote goes to Obama. The way I see it is that since McCain is philosophically aligned with the policies pursued by Bush (he is after all the Republican candidate) we can only expect more of "the same". On the issues that affect us I think Obama has the better plan for making a change. McCain's "message" is not getting through, therefore his only recourse is to create "issues" that attack the character of Obama in an effort to erode the support he has with the voters. If you can't win the debate on policy then attack the messenger - it is an old tired trick that will not work this time!

The right wingnuts have no shame. The primary purpose of Congress is to give authority to spend tax revenue. They take YOUR money and give it to others. John McCain has been "spreading YOUR wealth around" for 30 years. He's a socialist, too.

As for palling around with terrorists, McCain holds in high regard G Gordon Liddy (who held a fundraiser for McCain), who broke laws in the 70s as part of Watergate, the biggest Constitutional crisis we've ever had. He also had plans to kill a popular journalist at the time. He served 5 1/2 years of a 20-year sentence for Watergate. Is Liddy a terrorist? You decide.

As for raising your taxes, McCain's tax plan, for which 95 percent of us will NOT be better off, will raise the federal deficit MORE than Obama's (but neither will increase the debt as much as Bush has, so I guess it's a win for both), which means, at some point, we'll all pay MORE for his plan than for Obama's.

And don't forget about the "secret tax" -- inflation. Remember $4 a gallon gasoline? Don't think it's coming back? If we continually rely on, and "pal around with," foreign countries for their oil, we'll be there this time next year. The only reason gas has gone down in price is because of horrible demand due to the failed economic, fiscal, and monetary policies that have taken place under a Republican administration, and under a mostly Republican-led Congress (Democrats have let Congress for less than 2 years).

So, throw in the kitchen sink, right wingbats.

"Obama had an affair with a talking dinosaur and wants your children to become sex slaves." Go ahead. Make up some more BS. You guys sicken me.

Look, it does not matter what you say. Obama is a citizen, Obama is not a citizen. The GOP stole the last 2 elections, the GOP did not steal the elections.

No matter who wins we are going to have a certain level of chaos and God forbid violence no matter who wins as a result of the Balkinazation of the USA. It is very sad and as a Father and some one very very familiar with Republican Rome I fear for the future.

The one thing that is for sure is that if Obama does not win the GOP stole the election. No canidate has lost the Presidential election with the lead he has this close to the end. TO put it in perspective Bush only had a 3% lead in '04 and it was considered HUGE. Obama in all but one poll has a 6 point or greater lead. Even in my small Alabama home town his signs out number McCain 2 to 1 and to even get them you have to order them online and pay. Where McCain supporters can walk down town for free ones. What does that tell you? This is a very Republican 99% white conservative town.

Everybody including Republicans should be praying Obama wins simply because it will confirm we still live in a Democratic Republic and not an Oligarchy.

Why are people clipping this, exactly? Mashable's Mark Hopkins shared something similar on FriendFeed. We shut him down and he quit FF in a huff. This is a waste of all our energy to even respond. I would like a hide feature, not for people, but for articles/shares.

I know most wingnuts don't trust the media, but they do seem to trust FOX News, right? Have you seen them reporting on it at all? If there was any chance at all that this was true, you KNOW they'd be all over it, but they're not. That should tell you all you really need to know, eh?

Per the Second Article of the US Constitution, a US President must be a natural born US citizen, at least 35 years of age and have lived in the US for at least 14 years. In the case of Barack Obama, his citizenship is being question because people are questioning why his official birth certificates (or any other medical records)are not being made available. However, in my opinion, his citizenship should NOT be in question for a number of reasons.
Currently, Title 8 of the U.S. Code fillsshould clarify any questions people may have on this suject. Section 1401 defines the following as people who are "citizens of the United States at birth:"

* Anyone born inside the United States
* Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe
* Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
* Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
* Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
* Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
* Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
* A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.
Clearly, Obama fits several of these categories, and by trying to "disqualify" someone for a post that over 18 million Americans whom voted in the Democratic Primaries believe he is eligible for should show the world the depths of xenophobia that still remains in America. It kills me that people spew misinformation when you can check with the State department.

@leolaporte This is what the article refers to that I am wondering about Leo: The Obama campaign has tried to refute the allegations that he was born in Kenya by releasing a short version of his birth certificate on his campaign website. But the short version does not contain the state seal of Hawaii nor does it contain the requisite signatures to make it official. To date, the campaign has refused to release the full birth certificate. To make matters worse, the governor of Hawaii has had Obama’s birth certificate sealed from the public until November 5; the day after the election. And the Obama campaign itself has missed the federal deadline to file a vault copy – meaning an official copy – of his birth certificate. This is truly puzzling if there is no merit to the claim.

Wow. This is over and done with. In addition to the verification done by factcheck.org (a website promoted even by Fox News), Hawaii verified the certificate yesterday. Direct from the Associated Press website:

State declares Obama birth certificate genuine

HONOLULU (AP) -- State officials say there's no doubt Barack Obama was born in Hawaii.

Health Department Director Dr. Chiyome Fukino said Friday she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama's original birth certificate.

Fukino says that no state official, including Republican Gov. Linda Lingle, ever instructed that Obama's certificate be handled differently.

She says state law bars release of a certified birth certificate to anyone who does not have a tangible interest.

Some Obama critics claim he was not born in the US.

Earlier Friday, a southwest Ohio magistrate rejected a challenge to Obama's citizenship. Judges in Seattle and Philadelphia recently dismissed similar suits."

Time to move on to real issues.

Factcheck.org is not non-partisan, it's run by Annenberg which is the same group Obama used to work for...
It is interesting to consider who determines who is constitutionally eligible to run for president. It seems Obama would just produce the info so to quiet these people...

All these arguments are irrelevant as both candidates are simply opposite sides of the same coin. Obama is only going to win and survive if it suits the men behind the curtain who run the US. If he threatens to demolish the FED, (your privately owned bank that steals your tax money and prints counterfeit bills for your use), then a right-wing nutter will be found to assassinate him, same as JFK. Only when US voters elect someone not backed by either of the two shill parties will I believe in Democracy in your country.

This is the least of our worries with Senator Obama. Idiots like Michael Savage make true conservatives look foolish. I'm a conservative and I cant stand most of the garbage he spews. The focus of our attention should be on experience. All else aside, experience is what matters most and while I feel Senator Obama is a great person and cares deeply about this country and it's people, he just lacks the experience to be president of the United States of America at this time. I would feel much more comfortable if he had maybe 10 - 15 years of national political experience. Lets remember that he has only 173 working DAYS of experience in the senate. I cannot vote to put someone with such little experience in the White House.

@rhinnc is right. This whole thing can be debunked in the blink of an eye. The whole controversy is that they're not providing sufficient evidence. The birth certificate released is not sealed (of Hawaii) and signed and is therefore void. This is something that can easily be refuted, yet the records are FROZEN until after the election and no one is providing anything. Conspiracy theory or no, that smells foul to me. If there's nothing to hide, they why are they hiding? I, for one, would LOVE if they provide non-disputable evidence so the whole thing can be put to rest, but the truth is, they have not. The birth certificate is not official.

A vote for Obama is not for obama, but for a Pelosi blank check of policies that will even more cripple this nation without any checks and balance..

@bwana Ummm... seal and signature are on the BACK SIDE of the birth certificate original, and so therefore don't appear in a scanned version as provided. Actual certificate IS signed and sealed per confirmation of the officials in Hawaii. Don't spread misinformation.

@calgaryguru You just confirmed what I said. Do you know how easy it is to get a copy of a birth certificate for purposes like this? I can't get on a cruise ship without an _original_ copy of my birth certificate and the Obama camp provides a photocopy for proof of citizenship? And answer me this, why FREEZE the records until AFTER the election? Come on man. All I'm saying is, if it's not an issue, just provide valid proof and everyone will shut up. If you leave room for speculation, there will be speculation.
